EVICTIONS--Representing landlords in Maricopa and Pinal Counties. We have also made arrangements for coverage in Pima County evictions and can do evictions by telephone in many Justice Courts elsewhere in the State enabling us to keep landlord costs to a minimum.
MANUFACTURED HOME COMMUNITY ADMINISTRATIVE LAW JUDGE ACTIONS--throughout Arizona
ABANDONMENTS--We will handle your abandoned manufactured home situation whether the home is subject to a lien or free and clear. Be aware that most evictions if carried through to enforcing the judgment result in an abandonment.
REPOSSESSIONS--In 2011 the volume of our work repossessing mobile homes where buyers were in default in paying loans secured on them exploded. We now handle repossession work for a number of commercial lenders as well as park landlords selling and financing homes. For commercial lenders we require conflict waivers acknowledging that for homes in parks, they will follow the rules on the abandonments page of this website, and that our first duty is to client MHC's. Repossessions may only involve evictions or they may involve filing Replevin actions in Superior Court. If the home is legally affixed to land, we will refer the case out for a foreclosure sale and then handle the post foreclosure eviction.
DEALING WITH RENEGADES--If someone tries to remove a home from your community without your clearance, or sells to a third party who moves in without your consent, or repossesses a home in the community but won't pay rent, or in some other way disregards your rights as a landlord, we will correct the matter.
APPEALS--We will handle your appeal of a landlord tenant matter anywhere in Arizona whether to Superior Court or beyond.
DOCUMENTATION FOR MANUFACTURED HOME COMMUNITIES--All MHC's must have statements of policy, one and four year rental agreements, rules and regulations, disclosure forms, acknowledgments of receipt, and a variety of other forms unique to these kinds of communities. They must have notice forms which are also unique to MHC's. These forms must satisfy the unusual requirements of the Arizona Mobile Home Parks Residential Landlord and Tenant Act or the Arizona Long Term Recreational Vehicle Rental Space Act. We will prepare and keep these documents up to date as the laws or practices in the industry change.
LOAN OPINION AND DEFEASANCE LETTERS--When your community lender requires an opinion of Arizona counsel as to the enforceability of the loan documents, we will review those documents and provide the opinion at a very reasonable fee.
MANUFACTURED HOME COMMUNITY CLOSURES AND REDEVELOPMENTS--We will shepard you through the process of closing a manufactured home community, dealing with the Arizona Mobile Home Relocation Fund, and removing tenants in order to redevelop the land.
TRAINING--We conduct training sessions throughout the year for the manufactured home industry association in the areas of landlord-tenant and fair housing. This training satisfies the requirements for manager training in the Arizona Mobile Home Parks Residential Landlord and Tenant Act. In addition we will conduct special training for multi park operators in park operations and home sales, and for all kinds of landlords in Fair Housing Laws. All of our Fair Housing training is accepted as qualifying by the Arizona Attorney General's Office.
LITIGATION--If someone sues you for conduct arising out of your duties as a landlord, we will defend the suit.
FAIR HOUSING COMPLAINTS--We have been defending MHC's, apartments and other residential landlords against complaints alleging violations of Fair Housing Laws since 1988.
